ARRESTED FOR THE FIRST TIME?

You may be eligible for a second chance through Pretrial Intervention

What is PTI?

PTI is a program designed for first-time offenders of non-violent crimes.  This program consists of counseling, education, community service work, and other requirements that the participant must complete.  Successful completion of this program will allow for the arrest record to be destroyed.  The goal of this program is to give first-time offenders a second chance.  Offenders may participate in this program only one time.


 

 

 

 

 

Who is eligible for PTI?

The PTI Act of 1980 states that PTI shall be appropriate where:

  • Justice will be served by placing the offender in an intervention program;
  • The needs of the offender and the state will be better served outside the traditional criminal justice system;
  • The offender poses no threat to the community;
  • The offender is unlikely to be involved in further criminal activity;
  • The offender is likely to respond quickly to rehabilitative treatment;
  • The offender has no significant prior criminal history;
  • The offender has not previously been accepted in a Pretrial Intervention program.

Why should you participate in PTI?

A conviction will remain on your arrest record for the rest of your life.  PTI will offer you a chance to clear this charge from your arrest record.

"We take a tough stand on crime in the Eighth Judicial Circuit.  There are times, however, when it is appropriate to exercise compassion.  If you are a first-time offender and you sincerely want to mend your ways, you may be a good candidate for the Pretrial Intervention Program.  This program requires you to be a productive citizen by:
  • observing courtroom procedures in order to gain an understanding of the workings of court,
  • performing community service to repay the community for your transgression,
  • examining yourself by participating in counseling, and
  • submitting to drug tests

If you have caused any physical losses or damages to the victim of the crime, you will have to pay restitution.  Participation in this program is a privilege.  If you are diligent and complete all requirements assigned to you, you may have all the records of your charge destroyed or expunged.  This will allow you to "start over" without any criminal record.  This is an excellent opportunity for you.  I urge you to take advantage of the opportunity to apply for the PTI program.  Good luck."                                                                                                                                  ~ Jerry Peace, Solicitor



 

How does PTI work?

Application-The offender will bring in the warrant or ticket and a non-refundable fee of $100.00     (money order).  An interview will be conducted to gather background information.
Investigation-The PTI staff will contact all parties involved in the case for recommendations.
Approval-The Solicitor will make the final decision regarding admission to the program.  If denied, the case returns to court.  If approved, the case will be scheduled for orientation.
Orientation-The offender will pay the participation fee of $250.00 (money order) and requirements for completion will be assigned.
Dismissal-Upon successful completion, the expungement order for destruction of arrest records will be processed.
