Freedom of Information Act

Pursuant to the South Carolina Freedom of Information Act, the Eighth Circuit Solicitor’s Office will provide copies of public records in its custody unless the records are exempt from disclosure under S.C. Code of Laws 30-4-40.


Request & Response

A formal request for information must be made in writing to our office. The form below can be printed and mailed to our office or hand delivered. Requests can be mailed to:

State law requires that our office respond with a final determination and the reasons for that determination within 10 days of receiving the request, excluding weekends and holidays. If the information requested is older than 24 months, then our office has 20 days, excluding weekends and holidays, to make a final determination and respond to the request.

Once a final determination is made, our office, under state law, will have 30 calendar days from the date the determination was provided to produce the record or make it available for inspection and copying. If the requested record is more than 24 months old, then state law provides 35 calendar days from the date the determination was provided to produce the records or make them available for inspection and copying.

Fees

The 8th Circuit Solicitor’s Office charges the following fees as provided for under the Freedom of Information Act, Section 30-4-30(B):

Search and Retrieval Fee – $12.00 per hour
Redaction Fee – $16.00 per hour
Copy Fee – $0.10 per page

A 25 percent (25%) deposit is required of the total reasonably anticipated cost for reproduction of the records prior to the 8th Circuit Solicitor’s Office searching for or making copies of the records.
